Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website polymathtools.ai and any related services, tools, APIs, content, and features (collectively, the “Site” or “Services”) operated by Polymath Ventures LLC, a Wyoming limited liability company (“Polymath,” “we,” “us,” “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility

You represent and warrant that (a) you are at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater); (b) you have the legal capacity to enter into a binding agreement; and (c) your use of the Site does not violate any applicable law, regulation, or third-party agreement in your jurisdiction.

The Site is not directed to children under 13 and we do not knowingly collect information from children under 13.

2. Not Financial Advice

The Site is provided for educational, informational, and entertainment purposes only. Nothing on the Site constitutes — and nothing should be construed as — financial, investment, trading, legal, tax, regulatory, or accounting advice. See our full Disclaimer for details, which is incorporated into these Terms by reference.

3. No Fiduciary Relationship

Polymath is not a registered investment adviser, broker-dealer, commodity trading advisor, or fiduciary. No fiduciary or advisory relationship is created by your use of the Site. You are solely responsible for any financial, trading, or legal decision you make. Consult a qualified, licensed professional before making any such decision.

4. Premium Features and Paid Tiers

Certain features (including, without limitation, portfolio email alerts and the AI Market Analyzer at elevated usage tiers) may be made available on a paid subscription basis (“Premium”). If you subscribe:

• Billing is processed by our third-party payment provider (Stripe). You authorize us and Stripe to charge the payment method you provide.
• Subscriptions renew automatically at the end of each billing period (monthly or annual) until canceled.
• Cancellation: You may cancel at any time via the Stripe customer portal. Cancellation takes effect at the end of the current billing period.
• Refunds: Except where required by applicable law, subscription fees are non-refundable. We may, in our sole discretion, issue refunds on a case-by-case basis.
• Price changes: We may change Premium pricing on reasonable notice; changes take effect at the start of your next billing period.

5. Referral Program

We may, from time to time, offer a referral program (“Referral Program”) under which you may earn credits or free Premium time by referring new users. Referral rewards are (a) subject to anti-abuse rules at our sole discretion, (b) void where prohibited, (c) non-transferable, and (d) have no cash value. We may modify, suspend, or terminate the Referral Program at any time without notice.

6. Acceptable Use

You agree not to, and not to permit any third party to:

• Use the Site in violation of any applicable law, regulation, or third-party terms of service (including, without limitation, Polymarket, Kalshi, or Metaculus terms);
• Scrape, crawl, harvest, or extract data from the Site using automated means (except for compliant use of any public API we expressly provide);
• Reverse engineer, decompile, or attempt to derive the source code of any non-open portion of the Site;
• Overload, flood, or interfere with the Site's infrastructure (including denial-of-service attempts, excessive API calls, or circumvention of rate limits);
• Impersonate any person or entity or misrepresent your affiliation with any person or entity;
• Use the Site to promote gambling, trading, or financial products in a jurisdiction where such activity is prohibited;
• Use the Site to compete with Polymath by replicating its tools, content, or data feeds for a competing commercial service;
• Upload or transmit malware, spyware, or any harmful code;
• Use the Site to harass, abuse, defame, or threaten any person.

Violation of this Section 6 may result in immediate termination of your access and, where applicable, legal action.

7. Intellectual Property

All content on the Site — including text, graphics, logos, tool designs, calculator algorithms, written posts, AI-prompt configurations, and code — is owned by Polymath Ventures LLC or its licensors and is protected by copyright, trademark, and other intellectual-property laws.

You may view and use the Site for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any portion of the Site without our prior written consent, except that you may share direct links to public pages.

“PolyMath” and “polymathtools.ai” are marks of Polymath Ventures LLC. Third-party marks remain the property of their respective owners.

8. User-Submitted Content

If you submit any content to the Site — including, without limitation, email-capture submissions, portfolio data, AI Analyzer inputs, or feedback (“User Content”) — you grant Polymath a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, and display such User Content for the purpose of operating, improving, and promoting the Site. You represent and warrant that you have all necessary rights to submit the User Content and that it does not violate any law or third-party right.

9. Third-Party Services and Data

The Site integrates with and displays data from third-party services (including, without limitation, Polymarket, Kalshi, Metaculus, Stripe, Supabase, Resend, Buttondown, Formspree, OpenRouter, Carbon Ads, and Plausible). Polymath does not control and is not responsible for the accuracy, availability, terms, or practices of any third-party service. Your use of any third-party service is governed by that service's own terms and privacy policy.

10. No Warranty

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted by law, Polymath disclaims all warranties — express, implied, or statutory — including, without limitation, warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and availability. We do not warrant that the Site will be uninterrupted, error-free, secure, or that any output will be accurate or useful.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL POLYMATH VENTURES LLC OR ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES — OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR TRADING LOSSES — ARISING FROM OR RELATED TO YOUR USE OF THE SITE, EVEN IF POLYMATH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

POLYMATH'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO POLYMATH IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Polymath Ventures LLC and its members, managers, officers, employees, contractors, affiliates, licensors, and suppliers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any applicable law or third-party right; or (d) any User Content you submit.

13. Termination

We may suspend or terminate your access to the Site at any time, with or without cause or notice, including for violation of these Terms. Sections that by their nature should survive termination (including, without limitation, Sections 7–14, 16–18) shall survive.

14. Governing Law; Arbitration; Class-Action Waiver

Governing Law. These Terms and any dispute arising from or related to them or the Site shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict-of-laws principles.

Binding Arbitration.Any dispute, claim, or controversy arising out of or relating to these Terms or the Site — except for claims for injunctive or equitable relief to protect intellectual property — shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with arbitration seated in Cheyenne, Wyoming(or conducted remotely at the arbitrator's discretion). Judgment on the award may be entered in any court of competent jurisdiction.

Class-Action Waiver. You and Polymath each waive any right to a trial by jury and any right to participate in a class, collective, or representative action. Arbitration shall be conducted only on an individual basis and not as a class, consolidated, or representative action. If a court determines that this waiver is unenforceable, the unenforceable portion shall be severed, and the remainder of this Section 14 shall remain in effect.

30-Day Opt-Out. You may opt out of this arbitration provision by sending written notice to legal@polymathtools.ai within 30 days of first accepting these Terms, stating your name, account email, and a clear statement that you opt out of arbitration.

15. Changes to These Terms

We may update these Terms at any time. Material changes will be announced via a banner on the Site or by email (if you have provided an address). Continued use of the Site after changes become effective constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is held invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Disclaimer and Privacy Policy, constitute the entire agreement between you and Polymath regarding the Site and supersede any prior agreements.
